按照相关法律规定,房屋赠与的双方当事人应订立书面的赠与合同,这份合同并不是签订之后就立即生效,而是必须等赠与人把赠与房屋实际交付给受赠人,受赠人接受赠与房屋后,房屋赠与的民事法律行为才完成,合同才算生效。一、房屋赠与的详细流程是什么根据国家有关法律规定,进行房产赠与必须依法办理签约、申请、审核、登记及产权过户等手续。具体程序是:(一)签约。即房产赠与人同受赠人就无偿赠与签订房屋赠与合同(协议)书,表明无偿赠与是赠与人的真实意愿,接受赠与是受赠人的真实意愿。如受赠人为未成年人,赠与人单方出具的赠与书亦有法律效力。(二)办理公证。根据国家司法部和建设部《关于房地产登记管理中加强公证的联合通知》的规定,办理房产赠与公证。(三)申请登记。由赠与人和受赠人同时向房地产交易管理部门提交赠与房产和接受赠与的书面申请,办理赠与登记。在书面申请中,赠与人要说明赠与房产的原因,受赠人要说明与赠与人的关系,表明确系无偿赠与。所接受的赠与无买卖关系和其他经济上的交换条件。(四)提供证件。房产赠与双方当事人,在提交赠与申请的同时要提交以下证件:1、拟赠房产的权属证件(房屋所有权证和土地使用权证);2、赠与双方当事人签订的经过公证机关公证的房产赠与协议(合同)书;3、受赠人的户口及身份证明;4、受赠人是单位的,应在受赠申请中加盖单位公章,并经法人代表签字,还需附有受赠单位上级主管机关同意受赠的批件;5、代表他人办理赠与的,应提交代理人的身份证明及经过公证的委托代理书。(五)填写《房地产赠与申请审批表》。对表中有关各项内容必须如实填写。(六)审查。房地产管理部门受理并审查房地产赠与双方当事人交验的证件,进行产权及房屋状况的实际调查。(七)批准过户。房地产管理部门在认真审核确认无误后,应及时批准赠与房地产的过户,向受赠人核发新的房地产权属证件。二、房屋赠与的注意事项房产赠与人必须具有真实的意思表示,并且必须对其所赠房产拥有所有权。虽然取得赠与公证书可以迅速办理产权过户手续,但应注意几个事项:1、赠与是无偿的法律行为,法律后果不同于有偿的转让行为;2、是赠与后变更产权登记的税费与继承后变更的标准不同,办理前应向房管局、地税局等有关部门充分咨询;3、一般的赠与行为赠与人在赠与财产的权利转移之前可以撤销赠与,但是经过公证的赠与合同除外,也就是说经过公证的赠与行为一般不能撤销。
青岛市房产过户手续的办理流程:1、赠与人与受赠人签订房屋赠与书面合同,即赠与书。赠与书的主要内容为:(1)赠与人与受赠人的姓名、性别、出生日期和家庭住址;(2)赠与人与受赠人的关系;(3)赠与理由;(4)被赠与房产的名称、数量和基本状况、坐落地点;(5)赠与人对赠与行为的意思表示;(6)赠与人在赠与书上签名或盖章、日期。2、办理公证。根据司法部、建设部《关于房产登记管理中加强公证的联合通知》的规定,房屋赠与必须办理公证。办理赠与公证由赠与人住所地或赠与行为发生地公证处受理。赠与不动产的,也可由不动产所在地公证处受理。办理赠与公证申情人应提交下列证件和材料:(1)赠与人的身份证件(居民身份证、户口簿、护照、通行证复印件);(2)赠与书;(3)赠与物清单及所有权证明,如房产证、存单等;(4)赠与物为共有财产的,应提供共有人同意将财产赠与他人的书面意见;赠与物为集体所有的,应提交该集体组织成员同意赠与的书面意见;赠与物为全民所有的,应提交国有资产管理部门批准赠与的文件;3、办理房屋所有权转移登记手续。房屋赠与当事人到房地产管理机构申请变更登记,应提交下列证件:(1)房屋赠与申请表;(2)房屋权属证书(房屋共有的提供共有权证);(3)房屋户型平面图;(4)房屋赠与公证书;(5)赠与人及受赠与人身份证或户口复印件(与原件核对);(6)契税收据4、赠与人将房屋交付受赠人。这里的交付要以办理房屋产权转移登记为准。如果未办理产权转移登记手续,但当事人之间订立了书面赠与合同,赠与人已将原房屋产权证交给受赠人的,根据《最高人民法院关于贯彻执行〈中华人民共和国民法通则〉若干问题的意见》第128条规定,也应当认定赠与成立,然后补办过户手续。
