房产赠与是房产过户的一种过户方式。一、房产过户是指通过转让、买卖、赠予、继承遗产等方式获得房产,去房屋权属登记中心办理的房屋产权变更手续。即产权转移从甲方转移到乙方的全过程。房产过户有几种不同的情形,有继承的房产过户、赠与的房产过户、二手房过户等。二、赠与房产过户费用:1.营业税。免征。2.个人所得税。免征。3.契税:按国家规定3%-5%税率,一般3%,200万元×3%

以买卖的方式过户(房屋买卖手续费)这种方式直接到房产交易中心办理,缴纳1.5%的契税和0.1%的印花税,5.5%的营业税(满五年的免)和20%的个人所得税(差价的20%或房价的1%)。以赠与的方式过户(房屋赠与手续费)赠与要先进行公证,带房产证和两人的身份证到公证处办理。然后凭赠与公证书和上述证件到房产交易中心办理产区过户手续,缴纳房价3%的契税和0.05%的印花税,免其他税。父母子女之间的赠与过户手续费比交易的还要高,所以不建议做赠与,还是通过交易的方式比较方便。交易的方式就是和卖房子一样的。需要交纳的费用有契税,印花税和一些一些过户费用。
过户有两种方式,一是赠与过户,第二是买卖过户,如果该房产受让者今后打算转让,建议还是买卖过户,赠与过户免交营业税和所得税,契税和工本费还是要交,赠与还需办理公证手续,而且今后再次转让需交20%的所得税。
