房地产抵押登记基本程序如下:抵押登记申请办理房地产抵押登记,应当向登记机关提交下列文件:(1)房地产抵押登记申请书;(2)抵押当事人的身份证明或法人资格证明;(3)抵押合同;(4)《国有土地使用证》、《房屋所有权证》或《房地产证》;(5)可以证明抵押人有权设定抵押权的文件与证明材料;(6)可以证明抵押房地产价值的资料;(7)登记机关认为必要的其他文件。受理申请审查申请人所提交的文件是否真实、齐备,申请文件不符合规定的,不予受理;申请文件符合规定的,则予受理,给该申请编号并给回执,回执注明所收取的文件、受理日期和编号。审核(1)登记机关从房地产登记册查明申请转移登记的房地产权利状况,如有下列情形之一的,驳回转移登记申请:A.权属来源的性质是限制抵押(包括福利房、微利房,行政划拨土地、减免地价土地)而未取得有关部门同意的;B.根据城市规划,政府决定收回土地使用权的;C.司法机关、行政机关依法裁定,决定查封或者以其他形式限制房地产权利的;D.共有房地产,未经其他共有人书面同意的;E.权属有争议的;F.法律、法规或市、区政府规定禁止转让的。驳回登记申请,应自受理申请之日起在规定时间内书面通知申请人。
划拨土地房产抵押的流程:
一、贷款人所具备的条件
1、具有完全民事行为能力的自然人,在贷款到期日时的实际年龄一般不超过65周岁;
2、有本市常住户口,有固定的住所;有正当职业和稳定的收入来源,具备按期偿还贷款本息的能力;
3、愿意并能够提供贷款人认可的房产抵押;
4、房产共有人认可其有关借款及担保行为,并愿意承担相关法律责任。
二、所抵押房产的条件
1、房屋的产权要明晰,符合国家规定的上市交易的条件,可进入房地产市场流通,未做任何其他抵押;
2、房龄(从房屋竣工日起计算)+贷款年限不超过40年;
3、所抵押房屋未列入当地城市改造拆迁规划,并有房产部门、土地管理部门核发的房产证和土地证;
4、抵押物所有人可以是借款人本人或他人。以他人所有的房产做抵押的,抵押人必须出具同意借款人以其房产作为抵押申请贷款的书面承诺,并要求抵押人及其配偶或其他房产共有权人签字。
三、房产证抵押贷款流程
