赠与的房产过户需要什么手续:推荐阅读:房屋赠与过户费用(附需提交的资料及相关流程手续)根据《合同法》规定,房产属于不动产,在办理赠予时必须到房产管理部门办理房屋赠予过户,进行房屋赠予过户;否则,属于无效赠予。《人民法院关于贯彻执行《中华人民共和国民法通则》若干问题的意见(试行)》128条规定:公民之间赠予关系的成立,以赠予物的交付为准。房屋赠予过户,如根据书面赠予合同办理了过户手续的,应当认定赠予关系成立;未办理房屋赠予过户,但赠予人根据书面赠予合同已将产权证书交与受赠人,受赠人根据赠予合同已占有、使用该房屋的,可以认定赠予有效,但应令其补办房屋赠予过户。
1、赠与人与受赠人签订房屋赠与书面合同,即赠与书。赠与书的主要内容为:
(1)赠与人与受赠人的姓名、性别、出生日期和家庭住址;
(2)赠与人与受赠人的关系;
(3)赠与理由;
(4)被赠与房产的名称、数量和基本状况、坐落地点;
(5)赠与人对赠与行为的意思表示;
(6)赠与人在赠与书上签名或盖章、日期。
2、办理公证。根据司法部、建设部《关于房产登记管理中加强公证的联合通知》的规定,房屋赠与必须办理公证。办理赠与公证由赠与人住所地或赠与行为发生地公证处受理。赠与不动产的,也可由不动产所在地公证处受理。办理赠与公证申情人应提交下列证件和材料:
(1)赠与人的身份证件(居民身份证、户口簿、护照、通行证复印件);
(2)赠与书;
(3)赠与物清单及所有权证明,如房产证、存单等;
(4)赠与物为共有财产的,应提供共有人同意将财产赠与他人的书面意见;赠与物为集体所有的,应提交该集体组织成员同意赠与的书面意见;赠与物为全民所有的,应提交国有资产管理部门批准赠与的文件;
3、办理房屋所有权转移登记手续。房屋赠与当事人到房地产管理机构申请变更登记,应提交下列证件:
(1)房屋赠与申请表;
(2)房屋权属证书(房屋共有的提供共有权证);
(3)房屋户型平面图;
(4)房屋赠与公证书;
(5)赠与人及受赠与人身份证或户口复印件(与原件核对);
(6)契税收据
4、赠与人将房屋交付受赠人。这里的交付要以办理房屋产权转移登记为准。如果未办理产权转移登记手续,但当事人之间订立了书面赠与合同,赠与人已将原房屋产权证交给受赠人的,根据《人民法院关于贯彻执行〈中华人民共和国民法通则〉若干问题的意见》第128条规定,也应当认定赠与成立,然后补办过户手续。二手房房产过户需要什么手续:

1、夫妻离婚涉及房屋转移的,一般由双方共同申请登记,双方就财产达成协议到民政部门办理就可以了,但一定要及时办理房产过户手续。房产过户手续,即办理买卖过户,即按照正常买卖程序办理,一周左右时间即可。
2、对于离婚房产过户中,需要办理析产登记。夫妻离婚析产并不需要办理多少手续,只需按照房管局有关规定办理离婚析产登记。析产登记是一种常见的房屋登记种类,与继承登记及赠与登记也有一定的区别。析产登记主要适用于离婚析产。顾名思义,离婚析产是夫妻双方因离婚后彼此就个人对房屋所占的份额进行转移的一种登记手续。按照有关规定,双方免收交易税费。析产基本步骤:
(1)到公证处办理析产公证(注:如有离婚判决书的话则无需办理公证);
(2)到交易中心办理转绘;

1、要看房产证登记人和这位需要加名字上房产证之人。两人是什么关系来定!如果是夫妻,只需要房产证,契税证,结婚证,双方身份证户口本,到房管部门办理加名字,不收任何税费,只有手续费。
2、如果是直系亲属(父子,兄弟姊妹,爷孙)可以办理赠予或是买卖,把一部分产权过户,才可以办理加名字手续,需要交纳税费和手续费,
