家里的门窗框、门窗把手坏了,水阀、水龙头坏了,开关坏了、电源短路了,座便箱浮球不好用,室内墙皮脱落了等等,这些分户以内的业主自用部分,维修也好,更换也好,都是业主自己的事,不是物业公司的事。过去,房屋的所有权是政府或产权单位,这些事都该政府或产权单位管,现在房屋的所有权是业主,所有权内的事(不包括共有部位和共用设施)都该业主自己管。这些事也可以委托物业公司,但不属于物业公司的管理服务范围,而属于有偿服务范围。另外,召开业主大会、选举业主委员会、选聘或解聘物业公司、签订物业委托服务合同、制定管理规约等,这些也都是全体业主的事。这些事是开发商的事保修期内以及保修期内没修好的房屋裂缝、房屋透寒、烟道漏烟串味、墙面或楼顶防水、卫生间和厨房防水等问题,都是开发商的责任,与物业公司没有关系。由于新建小区的物业公司大部分隶属开发商,不少业主把应由开发商负责的问题都记到物业公司的账上,认为物业管理服务不到位。其实,开发商将房屋卖给业主后,房屋产权属于业主而不属于开发商,是选取开发商所属的物业公司还是选取其他的物业公司,由业主通过业主大会来决定。换句话说,无论是开发商所属的物业公司还是其他物业公司,都不承担应由开发商承担的责任。这些事是相关部门的事指导业主召开业主大会、管理监督物业管理服务、调节物业矛盾纠纷、查处业主家里被盗、处理违章搭建、违规改装修住房、业主占用绿地和道路等等,这些事是政府主管部门、街道社区、辖区公安部门的事,不是物业公司的事。这些事情,有的与物业公司没有直接关系;有的物业公司有责任配合和协助相关部门工作;有的物业公司有责任规劝、制止或向主管部门报告。这些事是相关企业的事业主家里的供水、供电、供气、供暖、电话、网络、有线电视等方面的问题,由社会公共事业企业或运营商负责解决,也不是物业公司的事。《物业管理条例》清楚表明,“物业管理区域内,供水、供电、供气、供热、通信、有线电视等单位应当向最终用户收取费用”。由于现在城市供水、供电等企业在收费时,仍看总表计费,并由物业公司按分户表代收代交,一些业主就认为是物业公司收水电费,实际上是物业公司替业主交费,替供水、供电、供暖等企业收费。由此看来一方面,物业公司不能将水、电、气费与物业服务费捆绑到一起收;另一方面,供水、供电等企业也应该付给物业公司一定的劳务费。目前,供水、供电企业除无偿占用物业企业的人力资源外,还由物业企业和业主承担总表与分户表之间的巨额差价,加重了物业企业和业主的经济负担。这些事才是物业公司的事物业公司管理服务的范围有哪些《物业管理条例》规定,物业管理是业主和物业服务企业按物业服务合同约定,对房屋及配套的设施设备和相关场地进行维修、养护、管理,维护物业管理区域内的环境卫生和相关秩序的活动。也就是说,物业服务企业是依照物业服务合同中约定的服务项目和服务标准,为业主提供质价相符的服务。业主和物业公司有关物业管理服务的依据就是物业服务合同,假如物业服务企业没有履行物业服务合同,侵害业主权益,业主可要求物业公司限期整改,也可向法院起诉。对业主要求解决的物业服务合同约定以外的事,物业公司应积极与有关方面反映沟通,争取使问题得到解决。要求物业公司承担物业服务合同外的工作,都属于变相侵占物业企业和广大业主的权益。一方面,物业费不能全部用于物业服务合同范围内的物业服务支出,对业主合法权益也是一种侵害;另一方面,增加物业服务企业成本,也影响物业企业的经营管理和服务。
一,不按时交纳物业费,物业有权起诉业主。假如过了追诉期,物业想告都没用了。二,入住时,业主与物业公司签署过物业托管协议,业主签过字,明确交纳物业费的义务,不交当然是违约了。物业可以起诉不缴费的业主。三,与物业有问题,有纠纷,业主应该找住建委的物管科投诉,物业做的再不对,再出格,业主同样可以起诉物业公司,但不能以拒交物业费的形式出现。
当然是物业公司进行维修处理了,又不在自己家里,这不需要业主自己维修处理的,楼主你大可以放心吧。
外墙渗水:接业主投诉是物业公司的职责,向发展商去函告是物业公司的职责,催促发展商维修处理是物业公司的职责。
