退房后按揭贷款怎么办?(一)因为房屋质量问题、房屋面积问题等理由退房的,而房屋上办理的按揭贷款还未还清的该怎么办?有这样一种误区:退房后,房屋所有权已经重新回到出卖房(一般是开发商)那里,因此银行贷款的还款责任应当由原出卖人承担。(二)其实,房屋买卖合同和银行贷款合同是两个独立的合同,房屋买卖合同是以房地产为标的的买卖合同,由出卖人和买受人签订的,银行贷款是房屋价金的一种支付手段;贷款合同是银行和买房人之间签订的,合同标的是所借款项,房屋在贷款合同中作为贷款的抵押物。正因为这两个合同是相互独立的,虽然在一定程度上存在一定联系(一个是以房屋为买卖对象,一个是以房屋为抵押物),但解除购房合同不代表连贷款合同也同时解除了,买房人和银行之间的借贷关系依然存在,借款还是要清偿的。
您好。退房办理方法:1、是否符合退房条件如在购房合同中已约定退房事宜,可依协议行事;也可对照《合同法》的相关规定申请退房。从目前法律来讲,退房条件主要包括约定条件与法定条件两种。约定条件是指购房者与开发商在购房合同中约定可以退房的条件。如开发商延迟交房超过一定期限,小区规划或配套设施不符合售楼广告或售楼书所表达的内容,在一定期限内无法取得产权证等。根据《合同法》规定,既然双方当事人已约定好退房的具体条件,且购房者又有证据证明该条件成立,那么购房者就可以通知开发商解除合同。这种情况下,一旦业主起诉,即使开发商推诿,也会得到法院的支持。2、协商不成再诉讼建议业主,如果满足合同约定的退房条件,最好还是先与开发商进行协商,这样可以省去诉讼费用。如果开发商提出的补偿条件能使业主满意,业主可根据自身情况收回退房要求,或在开发商协助下办理退房手续。如协调未果再选择诉讼或仲裁。业主未在合同中约定退房条款,但符合法定退房条件,法院也会支持业主的退房要求。对于未经合同约定也不在法定范畴内的退房请求,建议业主应先找开发商协调。通常在这种情况下提出诉讼,法庭鉴定过程相对较长。如业主发现墙体出现裂缝,可提出与开发商共同委托专业机构进行鉴定。若鉴定结果不会对房屋主体结构构成影响,并可以修复,法院将不予支持业主退房请求。但若鉴定后发现裂缝无法修复,法院则会支持业主的退房请求,同时会判鉴定费和业主的装修费由开发商支付。3、索要违约金及相关税费除房屋全价款及相应利息外,开发商还须赔付业主前期支出的费用。在索要违约金方面,如果是开发商违约导致退房,双方也在合同里约定了违约金,那么开发商须按约定赔偿。赔偿金除了房屋全价款及相应的利息外,还包括业主前期已支出的一些费用,如印花税、购房契税、交易手续费、测绘费、登记费、利息损失、购房代理费及律师费等,这些都算入消费者实际损失范围内,由开发商补偿。在退房款方面,采用一次性付款的购房者可直接要求开发商退还自己所付款项及相应利息。但通过按揭贷款、公积金贷款买房的情况则要相对复杂些。实践中,都是发展商将应退购房款分成两部分,属于买家首付款的部分直接退还给买家,属于买家向银行借款的部分直接交还给银行,并视为买家已向银行提前还款。银行接收还款并终止与购房人的借款合同。此外,开发商还应支付购房人首付款利息。即从首付款交付日到开发商归还日该笔首付款的利息收入。若购房人按揭贷款已进入月供阶段,开发商同样应归还购房人月供及利息支出。若购房者要求退房时,已居住了一段时间,这期间产生的折旧费应由业主补偿。在退房中若责任方为开发商,购房者可不对房屋折旧进行补偿,若是购房者的责任,开发商则可以不赔偿业主装修费。二、退房违约金1、退房违约金的数额违约责任取决于合同约定和法律规定,且约定优先。所以,合同中约定违约责任并明确违约金具体数额的,从其约定;如果没有约定,按照法律规定处理,如:支付定金一方违约的,定金不予返还;收取定金一方违约的,双倍返还定金。双方都有过错的,按照各自过错程度分担。违约金不足以弥补损失的,可以要求违约方按对方所受损失进行赔偿;违约金过高的也可以请求减少赔偿金额。2、退房违约金的程序首先写一个《退房申请》,在写《退房申请》时一定要注意自己是否要承担违约责任,如果要承担违约责任,一定要明确违约金的数额或者违约金的计算方法;其次,如果退房申请获得批准,和开发商签订《解除协议》,在《解除协议》中一要明确什么时候去房屋管理部门办理退房手续,二要明确什么时候退购房款,三要明确相应的违约责任;最后,在拿到退房款之前一定要保存好收据、合同等相关原件,以便发生纠纷时好维权。
