父母赠与房产过户费用:今年7月3日国家税务局发布房产赠与过户最新政策,规定4种房产赠与情况可以免税,而且公证书也不用再提供了。这四种情况是:
1.个人离婚财产分割无偿赠与。
2.无偿赠与特定亲属。
3.无偿赠与抚养人。
4.无偿赠与赡养人。具体是免征营业税情况是,离婚时财产分割、无偿赠与子女、父母、配偶、和祖父母外祖父母,孙子女外孙子女或者兄弟姐妹的。如果是无偿赠与承担抚养或者赡养义务的人员,最后是房屋产权人死亡,房屋产权的法定继承人、遗嘱继承人或者受遗赠人,都可以免征营业税。不用缴纳公证费用的也是以上4种情况,这四种赠与情况在办理营业税免税申请手续时,应向税务机关提交房产所有人“赠与公证书”和受赠人“接受赠与公证书”,或持双方共同办理的“赠与合同公证书”等赠与公证材料。父母赠与房产过户费用,有的省实行了新政策,直系亲属房子过户,不再有税务部门评估定价,可自行定价。但是要有个前提就是必须出示公安部门开具的直系亲属证明和户口本。比如爷爷要给孙子一套86平的房子,如果他们约定成交价是1千元,但是孙子名下已经有一套了那就要按第二套4%契税来收取,也就是40元。如果名下没有房子那就只用交1%的契税10元。营业税5.6%那就是56元。
契税分三个比例:90平米以下是1%,90--140是1.5%140以上就是3%。如果你名下有房子,那么就需要缴一个3%的契税(没有面积限制就是3%)如果是赠予的话,刚开始倒是简单省事,几百块钱搞定,但是以后你要是在想出售这个房子的话,那么就会有一个20%的个人所得税!
北京赠与房产过户费用要收取:
1、交易手续费:双方各50%,住宅:6元/平方米。
2、登记费:由受赠方交纳,住宅:80元/套;
3、房屋所有权证书工本费:一本免费,每增加一本收10元。
4、印花税:5元/本(由受增人交纳)。
5、契税:由受赠方交纳。1.5%税率征收。
