一、丙方同意甲方将自己位于街(路)号的店铺(原为:)转让给乙方使用,建筑面积为平方米;并保证乙方同等享有甲方在原有房屋租赁合同中所享有的权利与义务。

六、如乙方逾期交付转让金,除甲方交铺日期相应顺延外,乙方应每日向甲方支付转让费的千分之一作为违约金,逾期30日的,甲方有权解除合同,并且乙方应该按照转让费的10%向甲方支付违约金。假如由于甲方原因引发转让中止,甲方同样承担违约责任,并向乙方支付转让费的10%作为违约金。
七、如因自然灾害等不可抗因素引发乙方经营受损的与甲方无关,但遇政府规划,国家征用拆迁店铺,其有关补偿归乙方。

承租商铺应关注的十一事项
一、调查商铺的档案承租商铺之前,应当赴该商铺所在房地产交易中心进行产权调查,确认以下几个重大信息:
1、房屋的用途和土地用途,应该确保房屋的类型为商业用房性质、土地用途是非住宅性质方可承租作为商铺使用,否则,将面临无法办出营业执照以及非法使用房屋的风险。
2、房屋权利人,以确保与房屋权利人或者其他由权利人签署租赁合同。
3、房屋是否已经存有租赁登记信息,若已经存有租赁登记信息的,引发新租赁合同无法办理登记手续,从而引发新承租人的租赁关系无法对抗第三人,也会影响新承租人顺利办出营业执照。
二、确认商铺内煤气、水、电的容量是否符合要求;
三、把每年租金调整幅度事先约定于合同当中,明确何种条件下可调整房租;
四、确认商铺整修期是否免租,费用由谁来负担,租约到期之后,店面是否应恢复原状,最好把店面照片存档,并注明使用材质,作为日后原状归还的证明;
六、确认租约到期后如继续承租,要提前多久告知;
七、应当在租赁合同签订后到当地房地产管理部门办理登记备案。

一、做好证据保全工作承租人应该保存好的证据包括但不限于:
1.出租人同意装修的证据
2.出租人签字的租金收据
3.承租人的经营数据,如纳税记录可做为预期利益损失的参照依据等。另外,在承租商铺前,需要了解该商铺的商业规划和有关政策等。假如承租人将要经营的业态不符合相关的商业规划和有关政策,如承租一个不可经营餐饮行业的房屋准备开设酒店,必将引发人力和财力的损失。在无法确定的情况下,承租人可以在租赁合同中特别约定相关事宜作为解约条件,以此防止遭受不必要的违约责任。
店面转让关注事项
1、转让店面或商用房屋时,一定要签订正规转让协议,由房东、转让方、受让方三方签署。
2、关注营业执照是否随店转让、是否拖欠税费、房租、水电费等。
3、店面近期是否有拆迁的可能,以及遇到火灾、水灾等不可抗风险该怎么处理,可以到所在地街道办事处了解。
4、转让费应该由店面有形价值和无形价值组成。有形资产指装修、货物、桌椅货柜等,无形资产指地段、人流等。
第五条房屋拆迁补偿方式可以实行货币补偿,也可实行房屋产权调换。第六条被拆迁房屋货币补偿金额应当依照被拆迁房屋的区位、用途、建筑面积、成新等因素,由估价机构评估确定。被拆迁房屋室内自行装饰、装修的补偿金额,由拆迁人与被拆迁人协商确定;协商不成的,可以通过委托评估确定。土地补偿由拆迁人按土地使用证标注的土地使用面积,依据土地管理部门出具的标准对被拆迁人进行补偿。第七条拆迁可享受房改政策而未参加房改的直管公产及单位产权住宅房屋,房屋承租人选取货币补偿的,拆迁人应当将估价机构确定的房屋补偿总额中的10%付给房屋产权人,90%付给房屋承租人。第八条房屋产权证载明为住宅,实际用于经营12个月以上、已依法取得营业执照的经营性用房,按住宅房屋进行补偿或安置;但对用于经营的实际建筑面积部分,依照营业执照和纳税年限,可按以下标准调整房屋补偿价格:
(一)经营12个月以上的,评估价格上浮15%;
(二)经营24个月以上的,评估价格上浮20%;
(三)经营36个月以上的,评估价格上浮25%;
