房屋买卖合同网签备案、预告登记、抵押预告登记、预查封是针对房屋交易、抵押、查封等处置过程而产生的,有的属于行政管理行为,如网签备案,有的属于房屋权利人自愿实施的行为,如预告登记、抵押预告登记,而预查封则属于司法行为。这些概念与行为之间具有一定的联系,厘清各概念的含义、区别及联系,以求在实践中灵活有效运用,达成自己的经济预期。
一、房屋买卖合同网签备案房屋买卖合同依照其房屋状态类型,可以分为存量房买卖合同和增量房买卖合同,存量房是指已被购买或自建并取得所有权证书的房屋(其性质为二手房),而增量房是指房地产开发商投资新建的商品房,对二手房与新建商品房其买卖合同网签备案、预告登记、抵押预告登记、预查封等是有所不同的。
(一)房屋买卖合同网签备案
1、二手房买卖合同网签备案从各地实施的存量房买卖合同网上签约相关规定及实施流程看,二手房买卖合同网签是指买卖合同双方将自愿达成的房屋交易结果的主要内容如房屋问题、成交价格及成交方式等基本情况,通过房地产交易监管部门的网上签约系统录入备案,而对于买卖双方通过协商达成交易的其它内容,如违约责任、房屋的交付、权属转移登记等条款,交易监管部门并未录入,并且对于买卖合同的内容房地产交易监管部门不不予干涉。
2、增量房合同网签备案在增量房买卖合同(通常称为商品房买卖合同)中,合同一方当事人是房地产开发企业,另一方为购房人。从各地商品房网签的实践看,网上签约即是将买卖(或者预售)合同的签约过程及签约内容通过房地产交易监管部门的网上系统完成,并予以备案。网上签订商品房合同后,合同自签订时成立,签约方若要解除合同,应该双方签订新的协议并向且房地产管理部门提出申请才可以取消网上买卖合同。从以上网签流程可以看出,增量房买卖合同的网签实际上是一种房屋买卖合同内容的网络备案,主要是房地产监管部门基于规范市场、保证交易安全和保护购房人利益的目的,对房地产开发商的约束。
(二)房屋买卖合同网签的法律效力无论是存量房买卖合同的“网签”还是增量房买卖合同的“网络备案”,其本质上都是一种通过网络进行的行政备案。依据《城市商品房预售管理办法》第10条规定:商品房预售,开发企业应当与承购人签订商品房预售合同。开发企业应当自签约之日起30日内,向房地产管理部门和市、县人民政府土地管理部门办理商品房预售合同登记备案手续。网签及其备案不具有创设权利的功能,其目的是为了方便管理者的管理、监督和服务。作为一种程序性事实行为和行政法律制度,这种备案具有公示、确认和管理的功能。

二手房产证过户办理流程:
1、信息核对。买卖双方建立信息沟通渠道,买方了解房屋整体现状及产权问题,要求卖方提供合法的证件,包括房屋所有权证书、身份证件及其它证件。
2、签合同。如卖方提供的房屋合法,可以上市交易,买方可以交纳购房定金(交纳购房定金不是商品房买卖的必经程序),买卖双方签订房屋买卖合同(或称房屋买卖契约)。买卖双方通过协商,对房屋坐落位置、产权问题及成交价格、房屋交付时间、房屋交付、产权办理等达成一致意见后,双方签订至少一式三份的房屋买卖合同。
3、买卖双方共同向房地产交易管理部门提出申请,接受审查。买卖双方向房地产管理部门提出申请手续后,管理部门要查验有关证件,审查产权,对符合上市条件的房屋准予办理过户手续,对无产权或部分产权又未得到其他产权共有人书面同意的情况拒绝申请,禁止上市交易。
4、立契。房地产交易管理部门依照交易房屋的产权问题和购买对象,按交易部门事先设定的审批权限逐级申报审核批准后,交易双方才能办理立契手续。
