买二手房办理土地证需要买卖双方身份证、房产证、原土地证、合同、房屋过户的契税发票等材料原件及复印件,流程:
1、买二手房先办好房权证过户,之后双方带着身份证、房产证、原土地证、合同、房屋过户的契税发票等材料原件、复印件,到土管部门申请测绘、评估,出具测绘图和评估报告;
2、带着材料到土管部门受理窗口申请办理;因办房权证已经缴纳契税等费用,只需缴纳登记费(工本费)即可。
土地证过户费用有两种不同的情况
1、假如原土地证上土地的来源是转让的,就只要缴纳手续费。
2、假如土地来源是划拨的(单位福利分房后的房改房,所有公房转私房以后的房产都是),土地证过户时就应该缴纳当地地价3%的土地出让金了,这是一笔很大的支出。缴纳的土地证过户费用:契税1.5%,印花税5‰,假如是从中介买房,需付给中介代理费2.5%,另外假如需要贷款,还要支付银行的贷款费用,包括律师费评估费等。领取房产证以后办理土地证.假如土地是划拨的,还要缴纳土地转让金(当地政府确定的地价的3%),若土地是转让的,就不须缴纳,此外都是零星费用。以上费用需要符合的条件
1、房屋产权本已超过两年,如未到两年,加收一个5.5%的营业税,原则上由卖家承担。
2、房屋建筑面积小于140平。假如面积超过140平,(含140)契税交3%。
3、房屋是普通商品房。假如是已购公房还要支付一个土地出让金。
4、个人所得税现在没有强制收取,可以忽略不计。

11、房产证为共有的,提交《房屋共有权证》(验原件收复印件),不能共同来办理土地证的,提交授权委托书,委托代理登记的、涉外的参照第8条、10条办理(原件);
12、其他法律法规规定的相关材料。
