现在家装市场极容易出现工程纠纷,如转包、挂靠公司、装修质量、拖延工期、预决算争议等情况。为防止这类纠纷的发生,当我们装修时一定要签订家装合同来保证自己的利益。以免纠纷出现后麻烦不断,影响我们的装修进度甚至更大的纠纷。那么签订合同需要关注哪些细节?

2、然后增加材料环保性能条款甲方(业主)或乙方(装饰公司)提供的材料应当符合《室内装饰装修材料有害物质限量10项强制性国家标准》。早在2002年,国家质检总局就发布了《室内装饰装修材料有害物质限量10项强制性国家标准》,其中规定了水泥、砖、板材、油漆等室内装饰装修材料中的甲醛、苯、氨等有害物质的限量,不过有些装饰公司为了从材料中牟取暴利,故意在装修合同中漏掉有关材料环保性能的条款,侵害购买者的合法权益。对于采取半包形式的业主,这一点尤为重要,需要由装饰公司提供的夹板、胶粘剂、防水材料等都有可能成为室内污染物的重要来源。当然,这一条也为市民提了个醒,购买装饰材料别忘了查看环保检测报告。
3、实际约定质量责任归属由于乙方(装饰公司)原因造成质量事故,其返工费用由乙方承担,工期不变。在专业性、技术性较强的装修过程中,业主往往由于信息不对称而处于劣势,特别当出现纠纷时,装饰公司用各种借口要求业主承担部分费用。事实上,按照标准合同的规定,这些费用应由装饰公司承担。为了逃避责任,这一条被许多不良装饰公司故意漏掉,在发生质量问题时,以材料不合格等借口拒绝返工,更拒绝承担相关费用。为了保障自己的合法权益,网友完全可以把这一条款作为“工程质量和验收”部分的重要条款加入其中。并可以依照双方实际情况,约定更加实际的补充条款。
4、明确验收的实际事宜装饰工程未经验收或验收通不过的,甲方(业主)有权拒收,乙方(装饰公司)承担返工及延期交付的责任。有购买者投诉,工程还没有结束,就出现了墙砖脱落、木地板发霉的现象,装饰公司却以材料不合格或业主保护不当为由拒绝返工。其实,未经业主验收且未投入使用的项目出现质量问题,应由装饰公司承担责任,并且业主有权拒绝验收。为了防止装饰公司以材料不合格为由推卸责任,网友还可以在材料交接环节使用《材料交接单》,在材料使用前交由装饰公司验收,并进行详细记录。《材料交接单》可将材料的品牌、规格、数量、单价、总价等信息一一登记,日后验收通不过,网友可凭借《装修合同》和《材料交接单》要求装饰公司返工或赔偿。
