业主(Client/Owner)。工程建设项目的投资人或投资人专门为工程建设项目设立的*法人。业主可能就是项目最初的发起人,也可能是发起人与其他投资人合资成立的项目法人公司;而在项目的保修阶段,业主还可能被业主委员会(由获得了项目产权的买家或小买家*体组成,在国外也被称为业主法人团)取代。在中国传统的基本建设投资与建设行政管理体系中,业主也被称为“建设单位”。业主是在区分所有建筑物内或者在一个建筑区划内拥有一个或者一个以上专有建筑物空间或者房屋的所有权人。业主可以是自然人、法人和其它组织,可以是本国公民或组织,也可以是外国公民或组织。业主是在区分所有权制度下的一个法律概念。法律认定:依法登记取得或者根据物权法第二章第三节规定取得建筑物专有部分所有权的人,应当认定为物权法第六章所称的业主。基于与建设单位之间的商品房*民事法律行为,已经合法占有建筑物专有部分,但尚未依法办理所有权登记的人,可以认定为物权法第六章所称的业主。[3]相关区别:1、业主和房屋所有权人不是同意语。房屋开发商、投资商是建筑物所有权人,但一般不称为业主。2、业主是一个集合概念,具有*宗地并且只有一个所有权人的建筑物的所有权人也不成为业主,例如酒店、大厦的所有权人。3、按照共有关系拥有的建筑物的所有权人也不称为业主。
1.《物业管理条例》规定:业主委员会执行业主大会的决定事项,履行下列职责:业主委员会(一)召集业主大会会议,报告物业管理的实施情况;(二)代表业主与业主大会选聘的物业服务企业签订物业服务合同;(三)及时了解业主、物业使用人的意见和建议,监督和协助物业服务企业履行物业服务合同;(四)监督管理规约的实施;(五)业主大会赋予的其他职责。2.《业主大会议事规则》的规定:比如原上海市房屋土地*管理局颁布的《业主大会议事规则》(示范文本)【沪房地资物[2008]389号】规定:业主委员会除依法履行职责外,同时履行下列职责:(一)拟订选聘物业服务企业的方案;(二)拟订业主委员会的年度财务预算方案、决算方案,报业主大会决定;(三)拟订业主大会议事规则和管理规约修改方案,报业主大会决定;(四)拟订物业管理区域内公共秩序和环境卫生的维护等方面的规章制度的方案,报业主大会决定;(五)拟订物业管理区域内物业共有部分和共用设施设备的使用、收益方案,报业主大会决定;(六)拟订专项维修资金使用、续筹方案,报业主大会决定;(七)拟订改建、重建建筑物及其附属设施的方案,报业主大会决定;(八)对违反管理规约的行为进行处理。
房屋的所有权人为业主。在现实物业管理中,具备业主身份的情况有三种:一是房屋所有权*持有人;二是房屋共有权*持有人;三是待领房屋所有权*和房屋共有权*的购房人。在物业管理中,业主基于对房屋的所有权享受对物业和相关共同实物进行管理的权利。其中包括按照物业服务合同的约定,享受物业管理企业提供的服务;提议召开业主大会会议,并就物业管理的有关事项提出建议;提出制定和修改业主管理规约、业主大会议事规则的建议;参加业主大会会议,行使投票权;选举业主委员会委员,并享有被选举权;监督业主委员会的工作;监督物业管理企业履行物业服务合同;对物业共用部位、共用设施设备和相关场地使用情况享有知情权和监督权;监督物业共用部位、共用设施设备专项维修资金(以下简称专项维修资金)的管理和使用等。除享有以上权利外,还有权提议召开首次业主大会会议,有权推选业主代表,并享有被推选权。其中有些权利由单个业主享有和行使,有些只能通过业主大会实现。
