二手房交易是指已经在房地产交易中心备过案、完成初始登记和总登记的、再次上市进行交易。二手房是相对开发商手里的商品房而言的,是房地产产权交易二级市场的俗称,包括商品房、允许上市交易的二手公房(房改房)、解困房、拆迁房、自建房、经济适用房、限价房。流程为以下几步,(1)、*双方建立*沟通渠道,买方了解房屋整体现状及产权状况,要求卖方提供合法的*,包括房屋所有权*、身份*及其它*。(2)、如卖方提供的房屋合法,可以上市交易,买方可以交纳购房定金(交纳购房定金不是商品房*的必经程序),*双方签订房屋*合同(或称房屋*契约)。*双方通过协商,对房屋坐落位置、产权状况及成交价格、房屋交付时间、房屋交付、产权办理等达成一致意见后,双方签订至少一式三份的房屋*合同。(3)、*双方共同向房地产交易管理部门提出申请,接受审查。*双方向房地产管理部门提出申请手续后,管理部门要查验有关*,审查产权,对符合上市条件的房屋准予办理过户手续,对无产权或部分产权又未得到其他产权共有人书面同意的情况拒绝申请,禁止上市交易。(4)、立契。房地产交易管理部门根据交易房屋的产权状况和购买对象,按交易部门事先设定的审批权限逐级申报审核批准后,交易双方才能办理立契手续。现在北京市已取消了交易过程中的房地产卖契,即大家所俗称的“白契”。(5)缴纳税费。税费的构成比较复杂,要根据交易房屋的性质而定。比如房改房、危改回迁房、经济适用房与其它商品房的税费构成是不一样的。(6)、办理产权转移过户手续。交易双方在房地产交易管理部门办理完产权变更登记后,交易材料移送到发证部门,买方凭领取房屋所有权证通知单到发证部门申领新的产权证。(7)、对贷款的买受人来说在与卖方签订完房屋*合同后由*双方共同到贷款银行办理贷款手续,银行审核买方的资信,对双方*交易的房屋进行评估,以确定买方的贷款额度,然后批准买方的贷款,待双方完成产权登记变更,买方领取房屋所有权证后,银行将贷款一次性发放。(8)、买方领取房屋所有权证、付清所有房款,卖方交付房屋并结清所有物业费后双方的二手房屋*合同全部履行完毕。
首先*双方确认好房价,然后网签,签订购房协议,确认好首付款的时间,协议上会有明确的付款时间以及贷款方式,双方的责任和义务,然后银行面签,带着买方的相关*,银行会给一份购房合同成交板的,然后等着过户缴税,最后去银行二次面签,签订借款合同,贷款批贷,银行放款,过一段时间拿房本,提取公积金,大概就是这个流程。
二手房前提需要有足够的首付大约在30%,然后有大量的时间看房子,并且提供,*,户口本,银行流水,收入证明,结婚证(单身证明)。然后需要开购房*明。二手房的话,有房本的都可以贷款。二手房贷款的话是走商业按揭利率63.54,找一个正规的中介,虽然收一点点中介费。
一、看房:买方看房、*双方初步洽谈价格、付款方式、交房日期等事项,一般*双方产生的所有费用由*双方支付;二、查档:*双方持房产证原件或按揭合同原件到档案大厦国土部门查房档案;三、签合同:*双方协商房屋价格、定金、首期款、资金监管、贷款申请时间、赎楼费用、过户申请时间、税费支付方式、交房日期、租客情况、佣金的支付时间及比例、违约责任,确定这几大要点后,*双方与中介签订三方合同或者*双方签订合同,把上述内容写入合同(深圳市统一格式合同),支付定金给中介公司;四、卖方同担保公司到公证处进行公证,卖方委托担保公司办理相关事务;五、资金监管及贷款申请:买方支付首期款到按揭银行资金监管账号(一般是原贷款银行,如果换其他银行会多出一些费用),买方及担保公司与银行签订资金监管协议及相关文件(一大堆,都没看清楚,只是忙着签名),买方向银行提出贷款申请,银行同意贷款后出具贷款承诺书给买方(一般银行直接通知担保公司),约7~8个工作日左右;六、赎楼:买方向担保公司支付担保费用后,担保公司向原贷款银行申请赎楼,担保公司向银行出具赎楼担保,进行赎楼及注销抵押登记手续,约5个工作日左右;七、房屋过户:买方同担保公司去深圳市房地产产权登记中心三楼(金湖文化广场,位于银行*站和南方*厂之间)签订,递交房产过户申请,担保公司领取回执,需5个工作日;八、买方同担保公司到领证窗口签署回执缴费领取房产证(记得多复印一些,再见到它时要等全部贷款还清之后啦),担保公司领出新房产证同按揭银行在深圳市房地产产权登记中心作抵押登记,银行把首期款给卖方,新房产证抵押登记后,银行把扣除赎楼贷款后的贷款给卖方,约10个工作日左右;九、交房:*双方办理房屋交接,水、电等过户,买方领钥匙。7二手房按揭编辑1. 确定按揭服务公司和贷款方案 借款人在办理贷款前首先需要与中介确定按揭服务公司,并向按揭服务公司提出贷款咨询,确定贷款方案。2. 查询公积金(如需公积金贷款) 与卖方确定购房意向后,借款人提供公积金帐号,由按揭服务公司进行公积金查询,确定可贷款的金额和贷款年限。3.签定房屋*合同 借款人与卖方签定房屋*合同。由于交易中心要求不同,江岸、江汉、桥口、洪山等区的房屋,需在合同签好后到所在区域的交易中心办理房屋过户。4.准备贷款*,审核贷款资质 按揭服务公司协助借款人按照银行要求准备贷款*,有的房屋需要由指定的评估公司进*价评估;并且由按揭服务公司进行初步审核。5.签贷款协议,公证,保险 按揭服务公司将初审后的贷款*交贷款银行审核,通过后,按揭服务公司将安排借款人与银行签定贷款协议和办理协议公证,同时收取费用,包括房屋保险费等。6.办理房屋过户和抵押手续 借款人到房屋所在区的交易中心办理房屋过户和抵押手续,并将抵押收件收据通过按揭服务公司交贷款银行。7.办理房产证和抵押证明 贷款人的房产证和他项权利证明办出后,按揭服务公司将您的产证复印件和他项权利证明原件交银行。8.银行放款 银行在收到借款人的以上两证后,按揭服务公司将所贷金额发放给借款人。
