物业项目外包服务协议 甲方:****物业有限公司 乙方: *** 为规范服务好物业服务项目,甲方在与***置业有限公司签订的物业服务合同的基础上,根据物业管理条例和***市物业服务实施细则及相关物业法律法规要求,现将《尚东国际》小区的部分物业服务内容承包给乙方进行管理服务,双方经协商达成如下协议: 一、服务项目 (一)甲方外包《****》物业小区项目包括以下内容: 1、物业共用部位的维修、养护和管理(物业共用部位明细见附件二); 2、物业共用设施设备的运行、维修、养护和管理(物业共用设施设备明细见附件三); 3、物业共用部位和相关场地的清洁卫生,*的收集、清运及雨、污水管道的疏通; 4、车辆停放管理; 5、公共秩序维护、安全防范等事项的协助管理; 6、装饰装修管理服务; 7、物业档案*管理。 (二)在物业管理区域内,乙方的其他服务包括以下事项: 1、接管验收服务; 2、便民、*和特约服务(含有偿); 3、协助*相关部门开展对小区业主的有关服务。 不含公共绿化的日常养护。 二、服务标准 1、乙方应按照甲方与开发企业达成的物业服务协议内容和标准为基础,提供不低于**市物业服务等级标准中的五级物业服务分项标 2 准。(物业管理服务内容与质量标准见附件四) 2、物业委托*特约服务、便民和有偿服务、开发公司或业委会提出的其他服务内容达到业主满意。 3、单个业主可委托乙方对其物业的专有部分提供维修养护等服务,服务内容和费用由双方另行商定。 三、收费标准 1、收费项目和价格中物业服务费、装修押金、*清运费、车位费等乙方严格按照小区经物价部门审核的价格和时间收取,每年至少公示一次。 2、公共能耗费乙方按实收取,*建账并每半年公示一次。 四、甲方的权利和义务 (一)甲方的权利 1、甲方对乙方分包的项目享有质量监督和及时督促整改的权利; 2、甲方对乙方的收支享有财务管理和审核的权利; 3、甲方对乙方违反物业服务协议条款享有督促检查并要求及时整改的权利; 4、甲方对乙方管理的项目的重大事项享有知情和协调处理的权利; 5、甲方享有对乙方服务过程中的经营成本在收取的物业服务费中分摊的权利; 6、甲方在下列条件下享有收回乙方管理服务分类项目并要求乙方承担因此造成的各类损失和赔偿的权利: ⑴乙方服务达不到规定标准且不能及时整改; ⑵对乙方服务过程中因业户重大投诉或严重违反物业规定; ⑶损害公司形象的; ⑷受到物业上级主管部门通报批评的。 (二)甲方的义务 1、负有对《尚东国际》小区的接管验收义务; 2、负有审核提供乙方服务中针对本小区需要的各类服务证明和票据; 3 3、负有及时审核并发放乙方服务所需的各类成本,但支出扣除甲方规定成本后不得超出; 4、检查指导乙方的服务质量,受理乙方管理期间的重大投诉; 5、每月提供乙方财务收支报表。 五、乙方的权利和义务 (一)乙方的权利 1、乙方享有从事上述服务项目的*人事管理权,*承担员工薪资、福利待遇和用工风险; 2、从事上述服务项目的服务权利; 3、按照规定标准收取各类费用并支付相关分类管理成本的权利; 4、享有使用物业办公和经营用房的权利; 5、每月查看财务收支报表的权利; 6、享有开发企业对本项目物业补贴的权利; 7、乙方可采取规劝、报告有关行政主管部门、向地方法院起诉等必要措施,制止业主、物业使用人违反临时管理规约和物业管理区域内物业管理规章制度的行为。 (二)乙方的义务 1、制订物业服务方案,建立健全物业服务加架构并落实岗位责任制; 2、协助对小区进行承接查验,提出整改项目并督促开发企业及时完善; 3、服务所需人员工种和数量需报与甲方审核,一经审核不得无故变更,变更时应报与甲方批准; 4、所有收入必须及时打入甲方规定的帐户; 5、承担甲方管理服务中所必须的成本; 6、接受甲方对服务质量的监督检查并落实整改; 7、*承担分包项目所需服务人员的用工风险、*承担设施设备养护风险和物业养护责任险; 8、乙方应及时向全体业主通告本物业管理区域内有关物业管理的重大事项,及时处理业主和物业使用人的投诉,接受甲方、业主和
