次性付款的二手交易常规程序。签买卖合同,买方支付定金--递件(递交交易申请),买方支付首期房款(一般为房款的30%-50%)--问税、完税、过户,买方支付房款余额,卖方交付房屋--领证。按揭付款的交易常规流程:签买卖合同,买方支付定金--卖方协助买方签署相关文件,买方申请银行按揭贷款--取得银行同意贷款给买方购房的书面答复--递件,买方支付首期房款(一般是30%或除贷款部分的房款)--问税、完税、过户--领房产证--抵押--领他项权证--银行放款,卖方交付房屋即使是按常规程序办理,买卖双方都有一定的风险;如果是签合同或递件就付全款,风险就更大。房子再好再便宜,如果风险过大,都是得不偿失的。原有贷款的房屋,一般有如下的付款方式可适用办理交易。1)先还款,涂销抵押,后买方按揭付款或一次性付款。这种方式一般适用于办理买方一次性付款或买方要按揭选择的不是卖方原贷款银行或当地房管局要求交易房屋一定是完全产权不可有他项权人的。这种做法,常见卖方无力或不愿,而要求买方提前支付部分房款,垫资替卖方提前归还贷款。这种做法风险也是比较大的,主要是怕买方支付房款后到可以完成交易过户期间(此期间,在房管局的登记中,房屋产权仍属卖方),卖方房屋被查封,不可办理交易或因诉讼房屋无法出售给买方,其后,买方不仅不能购买房屋,且无法追回已付款项。如果你是第一次购买二手房或自己对二手房比较陌生或身边没有起码5年以上从业经验的专业经纪人及房地产专业律师从帮你操作的,最好不要采取这种付款方式,哪怕房子再便宜。如果是卖方自己出资提前还款后,递件时付首期房款的,则是按常规流程操作了。2)转按付款。在当地房管局开设了“带抵押过户”业务的地区、城市,买方是一次性付款且愿意选择卖方原贷款银行进行按揭的,此付款方式为首选这样付款,比卖方没有抵押的房屋交易,风险更低。同时也是二手房交易中,风险最低的交易付款方式)。这种付款方式就是买方、卖方与银行签订三方协议,在房屋仍是在卖方名下抵押给银行的情况下,先过户,然后涂销抵押,最后办理买方抵押的一种方式(房管局称为:带抵押过户,银行称为:按转按)。整个手续的办理,与买方办理按揭购房相似,只是多签署一份“转按协议”。不过,这种付款方式的前提,一定是当地房管局开设了“带抵押过户”业务,及银行开设了“按转按”业务的(一般房管局有带抵押业务的,当地银行通常都有按转按业务)。3、签协议并不能保证你没有风险。只是,买卖合同里如果对违约责任和违约赔偿签订的明确、情况估计充分的话,一旦纠纷产生诉讼时,对你比较有利而已。4、房产是否必须在产权清晰(没有抵押、查封、限制交易等情况)时,才可交易的,看你当地房产交易部门的具体规定。5、买二手房时,要注意的问题很多。最简单的法子是你有一位信得过,而且是具有多年从业经验的房地产经纪人或房地产专业律师的朋友,全程给你做顾问。如果没有,你要注意的问题太多。即使是买一手房,没有房地产方面专业知识,也是风险重重。其实许多购房者都是“勇者无惧”“不知者无惧”的。当然,风险发生的概率也不是很高,所以不幸的人,也还只是少数。你想学习的话,可以多逛逛房地产专业网站、论坛。陌生中介公司和经纪人的话,不能不信,更不能全信。
