法院拍卖的房子,一般不会允许通过房贷方式支付拍卖款。支付价款方式主要看拍卖公告及文件的约定。根据拍卖法第三十九条,买受人应当按照约定支付拍卖标的的价款,未按照约定支付价款的,应当承担违约责任,或者由拍卖人征得委托人的同意,将拍卖标的再行拍卖。拍卖标的再行拍卖的,原买受人应当支付第一次拍卖中本人及委托人应当支付的佣金。再行拍卖的价款低于原拍卖价款的,原买受人应当补足差额。
采取公开招标方式确定拍卖机构的,按照中标方案确定的数额收取佣金。拍卖未成交或者非因拍卖机构的原因撤回拍卖委托的,拍卖机构为本次拍卖已经支出的合理费用,应当由被执行人负担。根据上述规定如果拍卖成交的将由买受人向拍卖机构支付佣金,如果拍卖未成交或者非因拍卖机构的原因撤回拍卖委托的,拍卖机构为本次拍卖已经支出的合理费用,应当由被执行人负担。
交易方法及规定如下:成交后:由法院出具协助执行通知书和裁定持《拍卖成交确认书》到相关部门办理产权转移手续。根据《关于*法院民事执行中拍卖、变卖财产的规定》第三十二条拍卖成交的,拍卖机构可以按照下列比例向买受人收取佣金:拍卖成交价200万元以下的,收取佣金的比例不得超过5%;超过200万元至1000万元的部分,不得超过3%;超过1000万元至5000万元的部分,不得超过2%;超过5000万元至1亿元的部分,不得超过1%;超过1亿元的部分,不得超过0.5%。
