一、继承获得的房产房产继承是按照《继承法》的规定,把被继承人所遗的房产转归继承人的行为。房产继承是不需要交税的(包括契税、营业税和个税等)。但是有两个条件:一是继承应当在被继承人死亡后才能发生;二是继承遗产的应当是被继承人的法定继承人。《继承法》规定的法定继承人包括配偶、子女、父母、兄弟姐妹、祖父母、外祖父母、儿媳、女婿等。对于《继承法》规定的法定继承人(包括配偶、子女、父母、兄弟姐妹、祖父母、外祖父母、儿媳、女婿)继承土地、房产权属的,免征契税;按照《继承法》规定,非法定继承人根据遗嘱承受死者生前的土地、房屋权属,属于赠与行为,应征收契税,契税缴纳标准为总房价的3%;此外,生前就将房产权交给继承人的,也不是继承而是赠与。这两种情况均需要按赠与交税,契税缴纳标准为总房价的3%。需要特别注意的是:继承房产需要办理继承公证或遗嘱公证继承公证需交公证费80元/平方米,遗嘱公证需交公证费总房价的2%,另外,通过继承获得房产过户时还需要交相关登记费和手续费。二、赠与获得的房产通过赠与获得房产,需缴纳契税。根据《财政部、国家税务总局关于加强房地产交易个人无偿赠与不动产税收管理有关问题的通知》规定,对于个人无偿赠与不动产行为,应对受赠人全额征收契税,契税缴纳标准为总房价的3%。无偿赠与房产给他人,南京市目前执行的是免征营业税和个税。需要特别注意的是:非家庭成员之间的房产赠与合同,必须经公证处公证,需按房产总房价的2%交公证费;家庭成员之间的房产赠与,采用规范性赠与合同文本,赠与合同可以不公证。家庭成员指产权人的子女、父母、兄弟姐妹、祖父母、孙子女、外祖父母、外孙子女、公婆、儿媳、岳父母、女婿)。另外,通过赠与获得房产过户时还需要交相关登记费和手续费。继承、赠与获得的房产再出售税费怎么交?通过继承或赠与获得的房产再出售时,需要交哪些税费呢?主要区别在于个税的缴纳,直系亲属和非直系亲属有区别。根据《财政部、国家税务总局、建设部关于个人住房所得征收个人所得税有关问题的通知》规定,个人转让自用5年以上,并且是家庭唯一生活用房,免征个人所得税。也就是说,只要是满5年并且是家庭唯一生活用房,无论是继承还是赠与获得房产,再出售时都可以免征个人所得税。对于直系亲属之间的房产赠与(包括房产继承),获得房产后再出售,按规定交个税(全额的1%或者差额的20%)和营业税。直系亲属包括配偶、子女、父母、兄弟姐妹、祖父母、外祖父母、孙子女、外孙子女。对于非直系亲属之间的房产赠与,南京市目前执行的个税标准是:需缴纳全额的20%,个人所得税
转让受赠房屋的总收入×20%。此外,按规定交营业税。需要特别注意的是:判定房产交易是否满五年时,对于继承、遗嘱、离婚、直系亲属赠与、遗失补办等方式取得的住房,以原购房时间连续计算;拆迁偿还、非直系亲属赠与取得的住房,以本次领证时间计算。
