一、土地出让金是指:
1、各级政府土地管理部门将土地使用权出让给土地使用者,按规定向受让人收取的土地出让的全部价款(指土地出让的交易总额);
2、土地使用期满,土地使用者需要续期而向土地管理部门缴纳的续期土地出让价款;
3、原通过行政划拨获得土地使用权的土地使用者,将土地使用权有偿转让、出租、抵押、作价入股和投资,按规定补交的土地出让价款。
4、需要交付土地出让金的房屋主要有三种类型,即房改房、单位房和超过70年产权的商品房。
二、二手房土地出让金如何计算:
1、假如买卖的属于非出让国有土地使用权的土地,在办理土地出让时,其土地出让金由受让方按规定缴纳;假如买卖的属于已出让的国有土地,则买方应该支付土地使用权剩余年限的土地出让金。
2、出让金是国有土地所有权的经济体现,属地租性质。对商品房来说,当一个房地产开发商办理了合法的立项开发手续后,应该办理土地出让手续。此时国家按照土地总体规划的要求,将一定面积的国有土地使用权有期限、有条件地转让给土地使用者,并按规定收取土地出让金和使用税(费)。
3、二手房交易过程中的土地出让金,主要是针对房改房。即该房是在划拨的土地上建造的,交易时需补交土地出让金。由买方承担。其计算公式为:该套房屋建筑面积*当年成本价格*1%。当年是指缴纳土地出让金的当年,成本价格市区及郊区不一样。
4、土地使用税也就是土地出让金:依照《中华人民共和国城镇土地使用税暂行条例》第四条土地使用税每平方米年税额有这些:大城市0.5元至10元;中等城市0.4元至8元;小城市0.3元至6元。

2、抵押双方共同填写的《国有土地抵押申请审批表》;
3、双方填写土地抵押合同一式三份;
4、地价确认文件(地价评估报告、地价确认批复)各1份;
5、经公证的土地使用权抵押和贷款合同各1份;
6、以出让方式获得的土地使用权抵押登记应提供的资料:原土地出让合同出让金、契税缴纳凭证的复印件各1份;
