针对房屋遗产公证费用收取过高的问题,记者电话咨询了济南市公证处。公证处的工作人员告诉记者,房屋遗产公证费按收益额的2%收取,是国家统一规定的,他们也经常听到群众这样的反映,但作为公证机关只能按照规定收取费用,他们虽然也认为有些不合理,但也无能为力。据介绍,最早曾经有过按房屋面积计算公证费的情况,通常是每平方米40元,但在公证法出台后,物价局对于这种收费方式进行过检查,认为没有依据,并对行业协会进行过处罚。“其实按面积收取公证费也不合理,”这位工作人员认为,“还是按件收费最合理。”由于房屋遗产公证只是针对房屋遗产的事实情况进行公证,每一件公证的内容并不因房屋面积大小和价值高低而付出的劳动有所不同,真正影响公证工作量的是继承法律关系的复杂与否,他认为还是按件收费相对来说更为公平合理。继承房屋过户不同于买卖甚至赠与的过户行为,对于大多数工薪阶层而言,房屋可以说是价值最大的不动产物权,也许老人生前一辈子最大的遗产就是一套房子。而相对继承人而言,也许就一直容身于老人名下的房产,而当老人过世后,他们却不得不面对相对高额的过户费用。降低房屋遗产公证收费比例,或是改变收费方式以实际降低收费,都是减少社会成本的有效方法,也只有收费降低了,遗产继承人才不会受困于动辄几万、十几万的公证费而却步于过户程序
